RETURN & REFUND POLICY

This Return & Refund Policy applies to purchases made from Barok Fine Jewellery and is subject to applicable Spanish and European Union consumer protection law. Nothing in this policy limits the mandatory statutory rights of consumers.

ONLINE PURCHASES – RIGHT OF WITHDRAWAL

Consumers purchasing standard, non-personalised products online have the right to withdraw from the purchase without giving any reason within 14 calendar days from the day on which the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods.

To exercise this right, the consumer must inform Barok Fine Jewellery of the decision to withdraw before the 14-day period expires by means of a clear statement using the contact details provided on our website.

After notifying us of the withdrawal, the goods must be returned without undue delay and, in any event, no later than 14 calendar days from the date on which the withdrawal was communicated.

CONDITION AND USE OF RETURNED JEWELLERY

During the withdrawal period, jewellery may only be handled and inspected to the extent reasonably necessary to establish its nature, characteristics and suitability, in a manner comparable to the examination that would reasonably be permitted in a physical jewellery boutique.

The consumer is responsible for any reduction in the value of the jewellery resulting from handling or use beyond what is necessary for such inspection.

Jewellery should therefore not be worn or used beyond what is reasonably necessary to inspect and try the item.

Where returned jewellery shows signs of use beyond reasonable inspection, including scratches, marks, wear, damage, alteration, missing components or other deterioration, Barok Fine Jewellery may deduct from the refund an amount corresponding to the resulting reduction in value, to the extent permitted by applicable law.

Returned jewellery should be complete and, whenever reasonably possible, accompanied by the original packaging, certificates, laboratory reports, documentation and accessories supplied with the product.

The absence of original packaging alone does not automatically exclude the statutory right of withdrawal. However, any resulting reduction in value may be taken into account where permitted by law.

PERSONALISED AND CUSTOM-MADE JEWELLERY

The statutory right of withdrawal does not apply to goods made according to the consumer's specifications or goods that are clearly personalised, as provided by applicable law.

Depending on the individual order, this may include jewellery that has been specifically designed or manufactured according to the customer's specifications, engraved, personally inscribed, clearly personalised, or irreversibly altered according to individual measurements or specifications.

A standard product is not automatically excluded from the right of withdrawal merely because it was produced or obtained after the order was placed.

Where resizing or alteration has been requested, the withdrawal exception applies only where the resulting item qualifies as a product made to the customer's specifications or as a clearly personalised product under applicable law.

These exceptions do not affect statutory rights relating to defective or non-conforming goods.

RETURN SHIPPING

When exercising the statutory right of withdrawal for a non-defective product, the consumer bears the direct cost of returning the goods, unless Barok Fine Jewellery expressly agrees otherwise.

Due to the nature and value of jewellery, we strongly recommend using secure packaging and a tracked and adequately insured shipping service.

Customers are requested to contact Barok Fine Jewellery before sending high-value jewellery so that we can provide the appropriate return address and practical return instructions. This request does not restrict the consumer's statutory right to exercise withdrawal within the applicable period.

REFUNDS

Where the statutory right of withdrawal applies, Barok Fine Jewellery will reimburse the payments received from the consumer as required by applicable law, including the cost of our least expensive standard delivery method offered for the original purchase.

Additional delivery costs resulting from the consumer choosing a delivery method more expensive than our least expensive standard delivery option will not be reimbursed.

Refunds will be made using the same means of payment used for the original transaction unless otherwise expressly agreed.

Barok Fine Jewellery may withhold reimbursement until the goods have been received back or until the consumer provides evidence that the goods have been returned, whichever occurs first, where permitted by applicable law.

Any reduction in value caused by handling or use beyond what is reasonably necessary to inspect the jewellery may be deducted from the refund in accordance with applicable law.

DEFECTIVE, DAMAGED, INCORRECT OR NON-CONFORMING GOODS

The right of withdrawal is separate from the consumer's statutory rights concerning defective, damaged, incorrect or non-conforming goods.

If an item arrives damaged, is defective, is incorrect or does not conform to the sales contract, please contact Barok Fine Jewellery as soon as possible.

Nothing in this policy limits the consumer's statutory rights or the applicable legal guarantee under Spanish consumer law.

PURCHASES MADE IN OUR PHYSICAL BOUTIQUES

The statutory 14-day right of withdrawal applicable to distance contracts does not apply to purchases concluded directly in our physical boutiques.

Unless otherwise expressly agreed by Barok Fine Jewellery at the time of purchase, products purchased directly in our physical boutiques cannot be returned or exchanged solely because of a change of mind, personal preference or an incorrect size selected by the customer.

Personalised, engraved, altered or jewellery specifically made according to the customer's individual specifications cannot be returned or exchanged due to a change of mind.

Nothing in this section affects the customer's mandatory statutory rights where a product is defective or does not conform to the sales contract.

Proof of purchase may be required for any claim.

BUSINESS PURCHASES

The statutory consumer right of withdrawal applies to consumers. Purchases made by companies or professionals acting for purposes related to their trade, business or profession are not subject to the consumer right of withdrawal, except where mandatory law provides otherwise or Barok Fine Jewellery expressly agrees otherwise.
